Terms and Conditions of the Website

These terms and conditions apply to the use of this website, including the purchase of goods or services via the Hustled & Grind (H&G) website. Please read the following Terms carefully before placing your order. By completing your online purchase; you agree to be bound by the terms and conditions below.

Goods displayed on the Hustled & Grind website are available for purchase (subject to availability) online. These goods are also available for backorder if the website displays out of stock which have a dispatch ETA of 10 business days. The Customer must use the online order system to place an order for Goods via the internet. All orders not processed through our website are negotiated with the consumer as a custom order which is processed manually from an invoice. The Customer warrants that all information and data provided by him/her in the online order is accurate, complete and up to date. The Customer will promptly inform the Hustled & Grind sales team if there is any change to this information or data. After an Online Order has been placed, the Customer will receive an email confirmation of their order. Hustled & Grind will arrange delivery of the Goods to the address nominated by the Customer. The Customer is responsible for any costs associated with accessing the Hustled & Grind website and placing Online Orders including any internet service provider fees. Hustled & Grind may withhold supply of the Goods to the Customer where H&G has insufficient Goods to fulfil the order. A full refund of any amounts paid by the Customer will be made if the supply of Goods is withheld.

PRICING

You acknowledge that despite our reasonable precautions, products or services may be listed at an incorrect price or with incorrect information due to a typographical error or like oversight. In these circumstances, we reserve the right to cancel the transaction, notwithstanding that your order has been confirmed and we have received your payment.If a cancellation of this nature occurs after you have been charged for the purchase, within five days from the date of purchase, we will issue a refund to the value of the purchase of the goods or services confirmed at the time of purchase.

Prices listed are in Australian dollars and are subject to change but will not affect orders placed prior to a change to the price taking effect. All prices include Australian Goods and Service Tax (GST). Total GST will be calculated once items appears in the shopping cart ready for purchase. Special pricing are as shown on website. No further discounts will apply. Goods ordered are charged at the price applicable at the time the order is submitted. Upon purchase of the Goods, Hustled & Grind will provide a tax invoice specifying the total price for the Goods including delivery. Australia-wide delivery rates vary from $9.95 for regular and $14.95 for express. If the total order amount is equal too or more than $150.00, FREE shipping will be granted. FREE shipping is granted at standard delivery, not express. FREE shipping is also inclusive to website orders only, not custom orders unless negotiated otherwise. International shipping rates are calculated when the customer enters in their address on the shopping cart page.

PAYMENT TERMS

Hustled & Grind Pty Ltd. accepts PayPal, Master / Visa debit cards and After-pay as the payment method for all Online Orders. The Goods and Products will not be organized for dispatch until the Customer has paid all money owing to Hustled & Grind in full. Risk in the Products passes to the Customer at the time the Goods are delivered to the Delivery Address. All custom orders are processed via EFT (Electronic Funds Transfer), PayPal or Master / Visa debit card over the phone. After-pay is not a payment option for custom orders.

DELIVERY

Hustled & Grind ship all their orders via Australia Post. Anyone at the Delivery Address who receives the Goods shall be presumed by Hustled & Grind to be authorised to receive the Goods. If there is no-one at the Delivery Address or no-one of appropriate age to receive the Order when the Order is delivered; A collection card will be left at the address for the customer to contact and collect the goods or a possible ‘safe-drop,’ if a ‘safe’ spot is available to leave the order which is for the delivery guy to decide. H&G may retain possession of the Goods and charge an additional delivery fee when attempting to redeliver the Goods.

WARRANTY RETURNS, REFUNDS, EXCHANGES

No refunds will be provided for any products purchased over the website if you simply change your mind. However, if you are wanting to exchange an item, all returns must be done within 28 days of receiving the product; please contact Hustled and Grind via email and supply the details of the product you would like to exchange and the reason. Once confirmed and approved by Hustled and Grind. The customer will be requested to provide a prepaid regular or express postage bag with their returned items which should be in the original packaging. Hustled and Grind does not wear the cost for postage and if you fail to provide a prepaid postage bag with your return you will be given an in store credit for the value of the product only. Once goods are purchased they are unable to be cancelled unless in accordance with these terms and conditions. No refunds will be provided for cancelled orders once payment has been made. Goods incorrectly ordered or unused that are no longer needed by the Customer and are unopened may be returned to Hustled & Grind within 30 days. Postage will not be charge for return within 30 days, after 30 days the postage to return a purchase will need to be paid by the customer. Before returning Goods, the Customer must contact Hustled & Grind sales team. H&G reserves the right to use their nominated courier for returned Goods.

DISCLAIMER

This disclaimer set out in these terms and conditions does not attempt or purport to exclude liability arising under statute if, and to the extent, such liability cannot be lawfully excluded.

RESTRICTED USE

Unless we agree otherwise in writing, you are provided with access to this website only for your personal use. You are authorized to print a copy of any information contained on this website for your personal use, unless such printing is expressly prohibited. Without limiting the foregoing, you may not without our written permission on-sell information obtained from this website. The right to use this website is personal to you and cannot be transferred to any other person. We maintain the ownership of all copyright/trademark material downloaded from our website.

LICENCE / TRADEMARKS

The Customer acknowledges that Hustled & Grind or its related bodies corporate own or are licensed to use all intellectual property rights in the Hustled & Grind website (including, but not limited to, any images, photographs or text which appear on the web site). The Customer agrees that he/she will make no representation to the contrary, and that he/she will not use or copy H&G’s website or content in any manner which is inconsistent with the rights of the owner or licensee of such intellectual property rights. The Customer acknowledges that any trademarks or logos which appear on the H&G website are owned by or licensed to Hustled & Grind or its related bodies corporate, and that the Customer must not do anything to prejudice the rights of the trade mark owner or licensee to such trademarks or logos.

CHANGE OF TERMS

Hustled & Grind reserves the right to amend these Terms from time to time. Amended Terms come into effect from the time they are posted on the website. You should review this page regularly to ensure that you are aware of any changes to the terms prior to placing an order.
